TAN & MASSAGE PLUS NON FITNESS SPA MEMBERSHIP AGREEMENT FOR CORPORATES
I understand that I am enrolling in a Non-Fitness Spa Membership with The Alaska Club. In exchange, I will have access on an available basis to these monthly benefits/services:

- Massage Discount ($35 for 55 minute massage, up to 8 per month)
- HydraFacial Discount ($59 for 30 minute facial, up to 4 per month)
- Unlimited Hydromassage
- 3 Moisturizing Treatments
- Unlimited DVD/Blu-Ray rentals
- 10% Pro Shop Discount
- Free child care during massage and tanning appointments (up to 2 children)
- 3 Hot Yoga Sessions (redeemable only at Studio location)
I understand that with my corporate offer, I will receive 1 month free of the above mentioned services. After my first month, I understand that I will be billed $49.01 each month for a minimum of 3 months. I understand that membership in this non fitness program does not automatically terminate after the Subscription Term ends but continues on a month-to-month basis until a written notice is received. Notice may be submitted to Member Accounting at The Alaska Club East - 5201 E Tudor Rd., Anchorage, AK 99507 or firstname.lastname@example.org. Once written notice is received, cancellation will be effective on the next billing date.
No refunds will be given for unused sessions. Unused series or sessions do not roll over each month. DVD/Blu-Ray rental late fees do apply if not returned under the normal policy guidelines. A $35 no-show fee will be assessed if massage appointment is not cancelled at least four hours prior to appointment time.
Hot yoga sessions are a one time offer per 12 months of membership.
Non fitness members found using fitness, locker room, and services of The Alaska Club not specified will be assessed a $50 charge each time.
Tan & Massage Plus members must adhere to State Tanning Restrictions for minors. If member is under the age of 18, they must be accompanied by a parent and have parental permission to tan.
This offer is only valid to those that are non-fitness members of The Alaska Club and that work for an employer that has a corporate partnership with The Alaska Club.

ARTICLE I. WAIVER AND RELEASE OF CLAIMS
The member expressly agrees that use of the Club’s facilities, equipment and any transportation provided by the Club shall be undertaken by a member and his or her minor dependents at their sole risk. In consideration for membership in the Club, the member for himself/herself and on behalf of his/her heirs, successors and assigns, as well as on behalf of any minor dependents who utilize the Club’s facilities, does hereby forever release and discharge the Club, its owners, officers, employees, agents, assigns and successors from all claims, demands, causes of actions, lawsuits and liability for any death, injury or damages of any nature whatsoever incurred while using the Club’s facilities or equipment, or while participating in any Club sponsored activity, or while utilizing any transportation provided by the Club, including without any limitation, those injuries, deaths or damages resulting from acts of active or passive negligence on the part of the Club, its officers, agents or employees. This waiver and release of claims also covers any claim for personal injury or death resulting from a member’s medical condition that was in any way caused, triggered or exacerbated by use of The Alaska Club’s facilities or equipment. Further, in consideration for membership in the Club, the member releases and discharges the Club from any claim for personal property damaged, lost or stolen in or about the Club, or in lockers, or for loss or damages to any property including but not limited to automobiles and the contents thereof while on the Club’s premises.
ARTICLE II. PAYMENT OF DUES, FEES AND CHARGES
(a) The Club requires payment of dues and fees by Automatic Electronic Fund Transfers (ACH) or via a Credit Card. In some cases, a third party payment service may be used in lieu of directly processing member credit card information. By submitting credit card information, the member grants The Alaska Club the right to store and process their information with the third party payment service. The member agrees that The Alaska Club will not be responsible for any failures of the third party to adequately protect such information. All financial matters regarding their information are subject to the conditions of the third party payment service provider's terms of service; the current version of which is attached as a link at http://recurly.com/legal/terms. The member acknowledges that The Alaska Club may change the third party payment service and move member's information to other service providers that encrypt their information using secure socket layer technology (SSL) or other comparable security technology.
(b) Payments for any non-recurring charges at the Club require the use of a credit card, the details of which will be on file and maintained by the Club pursuant to the terms of any Payment Agreement.
ARTICLE III. MEMBERSHIP
Section 1. Nature of Membership. Membership is a non-transferable right which confers on the Member the sole right to use and enjoy the Club facilities in accordance with the rules and regulations as adopted and/or amended by the Club for the Non-fitness Spa Membership.
Section 2. Accounting. Membership terms are considered and accounted for monthly.
Section 3. Nondiscrimination. The Club accepts membership applications from any individual, family or business organization of good character and responsible credit background without regard to race, creed, color, sex or national origin.
ARTICLE IV. MONTHLY RATES AND CHARGES
Section 1. Dues. The obligation to pay dues is not dependent on the availability of all the Club’s facilities. Dues will not be reduced or suspended during the time when one or more of the facilities are not available. Annual increases in rates will generally occur in October of each year.
Section 2. Charges. (a) Online Services System. The Club has an Online Services System where a member is able to electronically pay dues and charges, access Club services and commit the member to services or other Club amenities (such as massage reservations) without personal interaction with Club staff. Member understands and agrees that by using the Club’s Online Services System, member will be bound by any such electronic commitment pursuant to the terms and conditions of this membership agreement and as set forth in the Uniform Electronic Transactions Act (AS 09.80.010 et seq.) until such time as the member withdraws, in writing, from the Club’s Online Services System. (b) Third Party Payment. If a member subscribes to an amenities package or purchase a particular service online, a third party payment service may be used in lieu of directly processing member credit card information. The member authorizes The Alaska Club to use a third party to charge their credit card or bank account and process payments for all fees payable during the Subscription Term. The member further authorizes consent to the disclosure of their payment information to such third party.
ARTICLE V. RULES, REGULATIONS AND POLICIES (collectively “Policies”)
Section 1. Publication and Access. The Club has adopted Policies for use of Club facilities which all members and guests are expected to honor as a part of this membership agreement. Policies may vary by Club location and are set forth and online at www.thealaskaclub.com.
Section 2. Changes. The Club may amend or adopt other Policies. New Policies or policy amendments will be published online at www.thealaskaclub.com.
ARTICLE VI. TERMINATION OF NON-FITNESS MEMBERSHIP
Section 1. Voluntary Resignation. Member may resign from The Alaska Club by giving a written notice to the Club and paying all dues or other charges outstanding. Voluntary resignation shall not be deemed effective until after the expiration of the 30-day or otherwise specified notice period and after all required payments have been made to the Club. Subsequent to voluntary resignation, the member shall not be subject to any further dues or other charges. Non-use of the Club is not considered notice of cancellation. Section 2. Involuntary Termination. The Club reserves the right at any time to terminate the membership of any member for failure to comply with any Policy adopted by the Club or for any conduct the Club determines to be contrary to the best interests of the Club. The membership may be terminated by notification in writing mailed by the Club to the first address shown on the records of the Club for the member being terminated. A terminated member will remain liable for all dues and other indebtedness incurred prior to the effective cancellation date. The membership any member who is 60 days in arrears with respect to the payment of his/her account to the Club may, at the Club’s option, be terminated.
ARTICLE VII. APPLICANT'S MEMBERSHIP IS SUBJECT TO THE APPROVAL OF CLUB
All applications and Agreements shall be on Club forms and shall be subject to payment of the required fees and approval of the Club. Persons under the age of 18 must have the signature of a parent or guardian assuming financial liability for membership and waiver of claims for the minor. By agreeing to the terms and conditions stated in this document, the applicant is stating that all information provided for membership is true and correct to the best of their knowledge. This agreement contains the entire agreement between the Club and the member and may not be modified verbally by any employee.
